On February 25, 1987, an application for a homeowner’s insurance policy was allegedly completed and a $200 premium check deposited by defendant Anatole P. Toran at the offices of the Lanor Agency (hereinafter Lanor), an agent of plaintiff in the City of Glens Falls, Warren County. Toran and his wife, defendant Mary C. Toran (hereinafter collectively referred to as defendants), further alleged that a $100 cash deposit was made on the policy in December 1986.
