Rose, J.(1) Cross appeals from an order of the Supreme Court (Relihan, Jr., J.), entered October 12, 1999 in Tompkins County, which granted third-party defendant’s motion for summary judgment and granted a declaration in favor of third-party defendant, and (2) appeal from an order of said court, entered October 22, 1999 in Tompkins County, which partially denied defendants’ motion for summary judgment dismissing the complaint.
