LaFray Mitchell and his wife, Mary Dee Mitchell, erected gateways 1 on “Lamar County Road Number 15950” (Road) which was used by Robert L. Ballard and his wife, Loyce J. Ballard, to access their property. The Ballards sued to have the Road declared a public road after “repeated demands that the gate be removed” proved unfruitful. A jury trial resulted in findings favorable to the Ballards, an award of attorney’s fees and costs in the amount of $10,446.63, and a judgment declaring the Road “a county road of Lamar County, beginning at its present point of origin…
