OPINION AND ORDER
PEREZ-GIMENEZ, District Judge.
This action was brought by Mr. Dionisio Martinez and his wife, Maria Julia Davila, to recover for injuries allegedly due to defendant’s negligence and to the condition of defendant’s vessel, the SS BOSTON.
*842Defendant filed a motion for summary-judgment on May 30, 1984, alleging that plaintiffs failed to prove the facts that could sustain their allegations or which could establish a legal basis for recovery.
