MEMORANDUM
HERMAN, District Judge.
On September 9, 1977 Plaintiff, Gus DiAntonio, filed a complaint against Defendants, the Pennsylvania State University, the Board of Trustees of the Pennsylvania State University, and John W. Oswald, individually and as President of Pennsylvania State University, in the Court of Common Pleas of Dauphin County, Pennsylvania. On September 30, 1977 Defendants filed a petition to remove the action to the United States District Court for the Middle District of Pennsylvania, and on October 10, 1977, Defendants filed a motion to dismiss certain causes of action…
