FUNDERBURK, Justice.
In due time, following an award of the Industrial Accident Board, the Southern Underwriters, compensation insurance carrier for J. C. Leitz, filed this action in the District Court against J. H. Erwin, employee of said Leitz. Erwin answered, in part, by asserting a cross-action to recover compensation insurance. The Southern Underwriters, who will hereinafter sometimes be called the insurer or defendant, took a non suit and filed defensive pleadings in answer to the cross-action.
