On September 7, 1929, Dr. S. P. Sesmer filed an ordinary action against the administratrix of the estate’ of Leonard Barton on a note for $1,866, dated December 8, 1920. The defendant pleaded non est factum,, and that the note was procured by fraud and misrepresentation. Dr. Sesmer also filed a petition in equity against the administratrix in which, he alleged that he’ had given Leonard Barton 695 treatments beginning' December 18, 1921, and ending December 28, 1928, for which deceased agreed to pay him at the rate of…
