Appeal from Eleventh district court. Action by Julius Falk and others against Leo Kareski and others for false representations. From a judgment in favor of plaintiffs, rendered by the justice without a jury, defendants appeal. Affirmed.

This action was brought to recover damages for false and fraudulent representations. The answer was a general denial. The pleadings were oral. The plaintiffs are copartners doing business under the firm name of Stern & Saalberg, and the defendants were, during the time or times of the transactions hereinafter referred to, copartners in business. From the testimony adduced on the part of the plaintiffs it appears that before the sale of certain goods, consisting of confectionery, by the plaintiffs to the defendants, the defendant Kareski represented to Stem, one of the plaintiffs, that the…
