Appeal by the People from an order of the Supreme Court, Kings County (Owens, J.), dated December 11, 1992, which granted the defendant’s motion pursuant to CPL 440.10 to vacate a prior judgment of the same court (Finnegan, J.), rendered February 28, 1986, convicting the defendant of robbery in the first degree, grand larceny in the third degree, criminal possession of stolen property in the third degree, and a violation of the Former Administrative Code of the City of New York § 436-5.0 (g), and directed a new trial.
