FLEMING, J.

Peter Pitchess, Sheriff of the County of Los Angeles, appeals a preliminary injunction 1 restraining him from enforcing sections 2061 and 2861 of county Licensing Ordinance No. 5860 against plaintiffs 7978 Corporation, doing business as The Middle- Earth, and Jack Devine, its president. At issue are the appropriateness of preliminary injunction as a remedy and the constitutionality of the licensing sections under attack.
