This case has an unusual history. On December 17, 1971, defendant was convicted by a jury of armed robbery, MCLA 750.529; MSA 28.797, and subsequently was sentenced to 8 to 40 years in prison. He filed an appeal with this Court on January 17, 1972, and appellate counsel was appointed. At that time, defendant had five other charges pending against him, including a charge of assault with intent to commit murder.
