delivered the opinion of the court.

While John H. Scott was riding along Galena street, in the city of Aurora, upon a light wagon, on the evening of October 6, 1896, he was violently thrown to the street and injured. He sued the city to recover damages therefor, claiming his injuries were caused by the defective condition of the street and that the city was negligent in permitting it to be in that condition.
