This is a suit to recover for personal injuries said to have resulted to' appellee from being thrown from a street car belonging to appellant. Appellee recovered a judgment for $3,250. On the trial a statement in writing, claimed to have been made by one Dr. P. EEewetson to an agent of appellant, was, in accordance with a stipulation of the parties, read in evidence by appellant as the deposition of the doctor. The substance of the statement so read was that the doctor had treated appellee at several different intervals during a period of about twenty years…
