Rsidue, L.L.C. v. Michaud

Court of Appeals of Wisconsin

Decided July 13, 2006No. 2005AP1299PublishedCited by 4 opinions

1Opinion of the CourtDeininger, J.

¶ 1. Rsidue, L.L.C., purchased Michael Michaud's overdue credit card account and brought this action to collect the amount due on it. The circuit court ordered the entry of judgment against Michaud. He appeals, claiming the circuit court erred in denying his motion to dismiss Rsidue's complaint for failure to comply with the pleading requirements set forth in Wis. Stat. § 425.109(1) (2003-04). We conclude that Rsidue is not a "creditor" within the meaning of the Wisconsin Consumer Act and is thus not subject to the pleading requirements of § 425.109(1). Accordingly, we affirm.
