MEMORANDUM OPINION

HEYBURN, District Judge.

Plaintiff, Keith Norman, moves to remand this product liability action to state court. Defendants, Sundance Spas, Inc. and Voyager Computer Corporation, affected removal based upon diversity of citizenship after the state court dismissed the only non-diverse defendant. Plaintiff argues two grounds for remand: 1) Defendants removed outside the one-year limitation period imposed by 28 U.S.C. § 1446(b); or 2) Plaintiff did not voluntarily dismiss the non-diverse defendant, a jurisdictional element of removal.
