This case came before the court below on the trial of an issue formed on the answer of the sheriff of Greene county to a rule obtained against him for money in his hands, which was contested by the parties claiming the same. It appears from *241the evidence in the record that a house and lot in the city of Greensboro was sold by the sheriff on the first Tuesday in October, 1873, under a mortgage fi. fa., in favor of Mayfield and wife, against Johnson, for the sum of $2,850 00; that A.
