Per Curiam: This contract case was referred, pursuant to Rule 57(a) (former Rule 45(a)), to Trial Commissioner Mastín G. White with directions to make findings of fact and recommendations for a conclusion of law. Commissioner White has done so in an opinion and report filed on April 28, 1964, recommending that judgment be entered for plaintiff for $69,369.72. The defendant has excepted to the recommendation, the opinion, and certain of the findings; the parties have filed briefs; and oral argument before the court has been had.
