Samuel Yarborough appeals from a summary judgment in favor of Springhill Memorial Hospital ("Springhill Memorial"). This action was filed by Samuel and Vicki Yarborough. Summary judgment was entered against Samuel Yarborough's claims only, and an appeal was taken. We remanded the case to the trial court, allowing it an opportunity to enter a final judgment on Samuel's claims, pursuant to Rule 54(b), A.R.Civ.P. Instead, the trial court entered summary judgment on March 2, 1989, against Vicki Yarborough, thereby creating a final judgment as to both plaintiffs. She failed to file a notice of…
