Two lawyers, Edwin E. Kaarela and Geoffrey F. Birkhead, representing the parties to a failed real estate deal have clashed over the return of the deposit money for nearly a decade. The litigation commenced in the Commonwealth of Virginia where Mr. Birkhead maintained his practice. Later in 1984, Mr. Kaarela, the buyer’s attorney, brought the present suit for breach of contract alleging that Mr. Birkhead had failed to perform an escrow agreement with respect to the security deposit.
