Defendant was charged with obtaining a controlled substance by fraud, MCL 333.7407(l)(c); MSA 14.15(7407)(l)(c). Defendant’s motion to quash the information was denied. Pursuant to a plea agreement, defendant pled guilty to the charge in exchange for the prosecutor’s agreement to withdraw a supplemental information charging defendant as a habitual offender by reason of three prior convictions for obtaining or attempting to obtain a controlled substance by fraud. On April 25, 1980, defendant was sentenced to serve 32 months to 4 years in prison. Defendant appeals by right.
