INTRODUCTION
Maria Conserve, mother of Sermisha Darius, and Serge Darius (“Plaintiffs”) brought a medical malpractice claim in 1998 against Warren Briscoe, M.D., and others on behalf of Sermisha Darius. The Plaintiffs contend that the Defendants caused the injuries suffered by Sermisha Darius during her delivery at Boston City Hospital on November 16, 1992. In response to this complaint, the Defendants filed a motion to dismiss on December 12, 1998, which the court denied.
