Scott Hudgens, owner of a large shopping center, sought a declaratory judgment and injunctive relief in the Fulton County Superior Court. There were three defendants: (1) a local labor union of the Retail, Wholesale, and Department Store Union, AFL-CIO, (2) an unincorporated association engaged in propagandizing against our nation’s participation in the Southeast Asia conflict under the name of "The Atlanta Mobilization Committee,” and (3) Richard Guy Steffel individually and as a member of that committee.
