At the trial of this case the plaintiffs obtained a verdict, and the defendant filed a motion for a new trial, alleging, as reasons for his motion, that the verdict was against the law and against the evidence and the weight of the evidence. After a hearing and argument, the judge granted the motion *143“ on the ground of misdirection in law.” No exceptions were taken to the rulings or refusals to rule at this hearing, or to the order granting the motion.
