BISSETT, Justice.

This is a suit for declaratory judgment. Preston Doughty and Roy Doughty sued Kenneth L. Bennight, Thomas O. Miller, O. A. Prather, Jr. and Fred R. Wade wherein they sought a judgment declaring that the defendants were each bound by the terms and provisions of a certain contract of sale of an accounting practice, dated July 18, 1966, which was executed by them, as sellers, and by Kenneth L.
