In an action to recover damages for personal injuries, the defendant Incorporated Village of Lattingtown appeals from so much of an order of the Supreme Court, Nassau County (Yachnin, J.), dated November 30, 1994, as denied its motion for summary judgment dismissing the complaint insofar as it is asserted against it.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the appellant’s motion is granted, the complaint is dismissed insofar as it is asserted against the appellant, and the action against the remaining defendant is severed.
