The action is upon two several claims. Each claim is based upon the acts of the state relating to the construction of the Barge canal at Baldwinsville and vicinity. The defendant does not interpose the question concerning the jurisdiction of the court to hear and determine upon the merits, in the action, items or elements of claims embraced in the two claims, whether they be considered as claims for appropriations or claims for damages for the invasion of property rights.
