O’NIELL, Chief Justice.

This suit was brought as an action to establish title to real estate. The action is provided for in Act No. 38 of 1908, for cases where two or more persons claim the same land by recorded title and no one has actual possession of it. The plaintiffs here claim 757/1470 interest in about 500 acres of swamp or timber land in what is called the Rio Hondo Claim No. 251, containing 632.78 acres. The defendants did not take exception to the form of action, but in their answer claimed that they were then and had been for more than thirty years continuously in actual possession…
