The defendant was found guilty of the crime of grand larceny as charged. He moved for a new trial, and this motion being denied, he was sentenced to im prisonment in the state prison for the term of ten years. This appeal is from the judgment.
Briefly the facts of the case are as follows: Three men, Williams, Ameral and Wilson, with the defendant Rollins, doing business under the.name of “The Hypatia Mining and Development Company,” entered into an arrangement for cheating and defrauding a certain class of laborers.
