The opinion of October 26, 2001, is withdrawn, and the following is substituted therefor.

Donald Ray Perine sued Dr. Yvonne Kennedy, individually and in her capacity as president of Bishop State Community College ("the College"), on September 8, 2000, seeking a declaratory judgment and injunctive relief. Perine specifically sought a judgment declaring that he had been terminated from his employment as an instructor at the College in violation of the "procedures, standards and requirements" of the Fair Dismissal Act, § 36-26-100 et seq., Ala.
