The facts in this case are not in controversy. The question presented for our decision is whether the conclusions of law and judgment are supported by the findings of fact. The trial court found that, prior to the closing of the defendant bank, plaintiff executed and delivered to the bank two promissory notes for the sums of $4,000 and $500; that the plaintiff had on deposit at the time of the closing of the defendant bank $2,445.371 that, prior to closing, the defendant bank without the knowledge of the plaintiff transferred the note for $4,000 to the War Finance Corporation and the note for…
