The matter before the court is the motion to dismiss the adversary proceeding *349by Christopher Haveri (the “Defendant”). The court held a hearing on this matter on May 21, 2009 in Raleigh, North Carolina. This order confirms and provides the rationale for the oral ruling at the conclusion of the hearing granting the motion to dismiss.
