We are asked to determine whether the appellant State of Minnesota can *353impose a 75-cent Health Impact Fee on the cigarettes of manufacturers that are parties to the 1998 settlement of the state’s tobacco suit, State by Humphrey v. Philip Morris USA, Inc., 2005 WL 3478647, No. C1-94-8565 (Minn.Dist.Ct. Dec. 20, 2005). Respondents Philip Morris USA, Inc., R.J.
