The plaintiff in error: was the conductor of a train of cars upon the Lake Shore and Michigan Southern Railway, between Elyria and Cleveland. Ulrich was a passenger, intending to *320go from the former to the latter place. The intermediate distance was twenty-five miles. The fare fixed by the company was ' ninety cents. Ulrich offered to pay seventy-five cents, which was at the'rate of three cents per mile, and refused to pay more.
