State v. King
Supreme Judicial Court of Maine
1Opinion of the CourtLevy, J.
[¶ 1] The State appeals from a judgment entered in the Superior Court (Hancock County, Harden, J.) granting King’s motion to suppress all evidence obtained from field sobriety tests conducted following the stop of her vehicle. The State contends that King’s response to the officer’s questions, coupled with the smell of alcohol on her breath, supported a reasonable, articulable suspicion that she was operating a motor vehicle while under the influence of intoxicants. Because we agree, we vacate the suppression order and remand for further proceedings.
