Allen, J.:

Rufus Leiter brought an action for divorce against Hazel V. Leiter, alleging extreme cruelty and gross neglect of duty. The answer of defendant contained a general denial and also a cross *288petition in which defendant prayed that she be granted a divorce against plaintiff. The cross petition charged plaintiff with extreme cruelty and gross neglect of duty.

Upon the trial the court granted a divorce to plaintiff and a division of property was adjudged. Defendant appeals.
