LARIMER, Chief Judge.

BACKGROUND

Appellants, Robert N. Kornfield and Karen E. Kornfield, filed a Chapter 7 bankruptcy petition on July 30, 1996. On January 15, 1997, the United States Trustee (“U.S.Trustee”) filed a motion to dismiss the petition for “substantial abuse” of the provisions of Chapter 7. Bankruptcy Judge John C. Ninfo, II, heard oral argument on the motion on February 12,1997. Judge Ninfo granted the motion and dismissed the case in a Decision and Order entered June 23, 1997.
