Personnelman First Class Richard C. Foster entered a plea of not guilty to two specifications of committing indecent acts with a child on divers occasions and one specification of communicating a threat, all in violation of Article 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 934 (2000). At the close of the Government’s case, the military judge dismissed one of the indecent act specifications on the grounds that the evidence was factually insufficient.
