Petitioner Christopher Ashby, appearing pro se, filed the instant petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254.

UNDERLYING FACTS AND PROCEDURAL HISTORY

In the evening of July 24, 1995, Petitioner, armed with a gun, and a co-defendant, Paul Henry (“Henry”), pulled Mrs. Shin Ja Chun from a walkway in front of her family’s Valley Stream, New York home, and dragged her inside the home.
