—Order unanimously reversed on the law without costs, motion granted and complaint dismissed. Memorandum: Plaintiff commenced this action to recover for personal injuries he sustained when he slipped and fell on an icy sidewalk outside defendant’s pizzeria. Defendant moved for summary judgment dismissing the complaint on the ground that plaintiff’s fall occurred during an ongoing ice storm and he had no duty to correct the icy condition of his premises during the storm.
