GODDARD, District Judge.

This is a motion for a preliminary injunction restraining the International Silver Company from selling to the highest bidder 6,000 shares of its common stock, pursuant to an invitation for bids sent out to its stockholders and the general public under date of November 1, 1924, and “from preparing or * * carrying out any further plans for the issuance of any common stock, * * * which shall have the effect of decreasing the interests of the holders of the common stock * * * in the surplus of the International.
