Pending before the undersigned, by the parties’ consent, are Cross-Motions for Summary Judgment concerning the Commissioner’s decision denying Ms. Barton’s claim for Disability Insurance Benefits (“DIB”). (Paper Nos. 5, 12, 21). The Commissioner filed a Motion to consolidate this case with another case, Juanita Waters v. Astrue, PWG-06-101, and a Motion for En Banc Consideration of both cases.
