Defendant Johnson Controls World Services, Inc. (Johnson) pursues this interlocutory appeal from an order of the district court denying its motion to dismiss Plaintiffs claims for personal injuries which arose out of and in the course of his employment with Johnson. The central issue presented on appeal is whether the district court erred in holding that Count I of Plaintiffs complaint sets forth a valid claim for damages for personal injuries outside the exclusivity provision of our workers’ compensation statute, NMSA 1978, Section 52-1-9 (Repl.Pamp.1991).
