This case was originally brought by the Board of Commissioners of Tippecanoe County, as a stockholder in the Lafayette, Muncie, and Bloomington Railroad Company. Certain proceedings were had, and changes in the pleadings made, which need not be noticed in detail. The case comes before us on the original complaint, in three paragraphs, with the appellants herein as plaintiffs, and the appellees as defendants below, and with an answer to the original complaint of one special paragraph, to which a demurrer was filed for want of alleged facts, and overruled; exception taken, and judgment on the…
