Plaintiffs, PI Telecom Infrastructure V, LLC, Célico Partnership d/b/a Verizon Wireless, and Albert Burke, (collectively as the Applicants), challenge the Defendant’s, the Georgetown-Scott County Planning Commission (the “Commission”), denial of their application to construct a cell phone tower on a 36.5 acre tract of land in Scott County, Kentucky, as viola-tive of the Telecommunications Act of 1996, 47 U.S.C. § 151 et seq.
