1Opinion of the CourtScates, J.

This bill was filed by the ward against the testamentary guardian for an account, charging that lands and moneys had come into his hands as guardian.

The guardian answers, admitting that in recovering the estate of the ward out of the hands of the executor of the will, he had acquired title to certain lands purchased under an execution on a judgment against the executor for $418.75, and conveyed to him on 7th November, 1843. He admits assets to the value of this land to be $427.12, and then states and sets up an account for maintenance and education and expenses exceeding the assets.
