BARNES, Presiding Judge.
Alan David Tucker and Alan David Tucker, Esq., PC., appeal the trial court’s grant of partial summary judgment on liability to Tucker’s former client James Rogers in this legal malpractice case. For the reasons that follow, we reverse.
“To prevail on summary judgment, the moving party must show that no genuine issues of material fact remain to be tried and that the undisputed facts, viewed in the light most favorable to the nonmovant, warrant summary judgment as a matter of law.” (Citation omitted.)
