I. INTRODUCTION

Presently before the Court are Plaintiffs motion for summary judgment, the cross-motion for summary judgment of Defendants Pataki, Doherty, Natoli, Finnegan and Maul (collectively the “Executive Department Defendants”) and the cross-motion for summary judgment of Defendants Vacco and Flynn (collectively the “Law Department Defendants”).
