Plaintiffs Paul Isacoff (Isacoff), owner of real property in West Haven, and Yale Auto Parts, Inc. (Yale), lessee thereof, seek damages pursuant to 42 U.S.C. § 1983 based on the 1978 and 1980 denials of Yale’s application for a certificate of location approval — a prerequisite to a state Department of Motor Vehicles (DMV) license to operate an automobile junkyard business — by the West Haven Zoning Board of Appeals (ZBA).
