OPINION

PRICE, Justice (Assigned).

A jury found appellant, Derek Ian Hilla, guilty of murder as charged in the indictment, and further found that he used or exhibited a deadly weapon, his foot. The jury assessed punishment at 45-years confinement and a $10,000 fine.

On the evening of August 8, 1990, a group of teenagers, including appellant, co-defendant Kevin Allison, Christopher Miels, Rob Lyne, and Jesse Neff, were “hanging out” and drinking at the home of Paul Bobbit on Carolcrest while Bobbit’s parents were absent. Miels characterized himself, appellant, Allison, and Neff as “skinheads,”…
