MEMORANDUM OPINION AND DECISION

RICHARD L. SPEER, Chief Judge.

This cause comes before the Court upon the Motions for Summary Judgment filed by the Plaintiff and Defendant. This Court has reviewed the arguments of counsel, exhibits, and the entire record of the ease. Based upon that review, and for the following reasons, the Court finds that the Motion for Summary Judgment of the Defendant should be denied, that the Motion for Summary Judgment of the Plaintiff should be granted, and that the Debtors’ payment to Defendant in the amount of Nine Thousand Nine Hundred Fifty and 10/100 Dollars…
